EU Vape Compliance Now and What May Change Next

Table of Contents

    European vape buyers are working on two timelines. Existing Tobacco Products Directive rules still decide market access, while a 2026 EU review points toward possible wider controls. A clean SKU record separates duties already in force from proposals, records each target country and keeps product changes traceable.

    The Current Baseline Still Decides Market Access

    Article 20 of Directive 2014/40/EU remains the baseline for electronic cigarettes sold as consumer products in the EU. It covers safety and quality, notification, packaging, labelling, advertising and reporting. The 2026 review did not replace those duties, so stock must still meet today’s rules.

    Two numbers define the nicotine-liquid boundary

    For nicotine-containing liquid, a disposable e-cigarette, cartridge or tank may hold no more than 2 ml, and nicotine concentration may not exceed 20 mg/ml. These are entry points, not complete approval. Child resistance, tamper evidence, ingredient purity, consistent nicotine delivery and appropriate warnings still matter.

    Notification timing begins before commercial launch

    Manufacturers and importers must notify a new or substantially modified e-cigarette to each intended Member State through the EU Common Entry Gate. The deadline is six months before planned market placement. Compliance is therefore a launch dependency; a late formula, coil or pack change can disturb the submission and schedule.

    Labels, Leaflets, and Files Must Describe One SKU

    For closed pod system vapes, the sealed format increases the importance of factory-controlled identity. The liquid, strength, pod volume, coil, device, pack text and notification must refer to one version. A buyer should be able to trace a finished unit to its approved artwork and technical record.

    Packaging must carry nicotine information and the required health warning when nicotine is present, list ingredients, and include a leaflet covering use, adverse effects, risk groups, addictiveness and toxicity. Promotional claims belong in the same approval flow because an unsupported statement can hinder market placement.

    Before release, the SKU file should lock these connected elements:

    • the intended market and language version;
    • pod volume and nicotine strength;
    • ingredient and emission data used in notification;
    • device, coil and liquid configuration;
    • final packaging, warning and leaflet version; and
    • change owner, approval date and effective batch.

    S05 Turns the Rules into a SKU Check

    A regulation becomes useful only when it can be checked against a defined product. In NICOMORE’s S05 vape pod system, the pre-filled pod holds 2 ml and comes in 0 mg, 10 mg and 20 mg strengths. The nicotine variants sit at or below Article 20’s ceiling, while the fill matches the cartridge limit. These are useful screening points, not proof of complete compliance.

    The 0 mg variant needs a separate destination review. Parts of the EU-CEG data framework may also apply to nicotine-free products, while national rules can go further. Separate SKUs prevent warnings, submissions or market assumptions from drifting into the wrong strength.

    Pod fill 2 ml pre-filled e-liquid Matches the Article 20 volume ceiling for nicotine-containing cartridges
    Strengths 0 mg, 10 mg and 20 mg 10 mg and 20 mg are within the current 20 mg/ml ceiling; 0 mg needs a separate market review
    Device identity 500mAh battery, 1.6-ohm mesh coil, 600-puff claim Keep the physical configuration consistent with the reviewed SKU file
    Dimensions 16 mm diameter × 108.3 mm height Use the same identifier across samples, artwork and purchase specifications

    Battery capacity, coil resistance, puff claim and dimensions do not replace regulatory evidence, but they help distinguish the reviewed S05 configuration from a look-alike sample or later change.

    Country Variation Belongs in Launch Planning

    Harmonised rules are only one layer

    EU rules create a common floor, yet Member States retain choices on nicotine-free products, flavours, fees, registration and cross-border distance sales. One “EU-compliant” folder is too vague. A country matrix should record the authority, notification status, local-language pack, tax or registration checkpoints, sales limits and verification date.

    Supplier control must follow the market map

    A buyer comparing wholesale vape suppliers should ask who owns the submission, approves artwork and updates every country file. NICOMORE supports OEM/ODM work with in-house R&D, quality control and automated pod production. That role matters when it keeps the approved configuration repeatable and gives importers notice before production changes.

    EU-CEG requires a new notification for a substantial modification, so teams should define that trigger before purchase orders begin. A new liquid recipe, strength, coil, pod volume, device configuration or label claim should pause release until a regulatory reviewer decides whether the existing notification still applies.

    The 2026 Review Is a Signal, Not a New Rulebook

    On 2 April 2026, the European Commission published its tobacco-control evaluation. A follow-on call for evidence gives an indicative December 2026 timetable and identifies possible work on flavours, disposables, non-nicotine systems, packaging and digital marketing. These are policy directions, not a finished replacement for Directive 2014/40/EU.

    Wholesale planning can respond without guessing the final text. Contracts can require change notices, editable country artwork, versioned technical data and lead time for re-notification. Buyers can also avoid locking too much stock into one pack design while national controls remain fluid.

    A Living SKU Record Is the Practical Takeaway

    Compliance aligns the product, submission, pack and destination; readiness keeps that alignment easy to update. For S05, the record should separate 0 mg, 10 mg and 20 mg variants, lock the 2 ml pre-filled configuration, name each target country and record approved changes. This evidence chain is stronger than a broad compliant label.

    European buyers can ask NICOMORE to map the intended S05 configuration and OEM artwork to a market-by-market review before scheduling a launch.

    FAQ

    Does EU law still cap nicotine pods at 2 ml?

    Yes. Article 20 caps tanks and cartridges containing nicotine liquid at 2 ml. Notification, ingredients, warnings, packaging and technical safety must also be checked.

    Is 20 mg/ml still the maximum nicotine concentration?

    Yes. Nicotine-containing liquid is capped at 20 mg/ml. A 20 mg product reaches the ceiling, so measured content and declared strength must remain controlled.

    When must an EU-CEG notification be filed?

    Manufacturers or importers must submit information to relevant Member States six months before a new or substantially modified e-cigarette is intended for market placement.

    Are the 2026 revisions already law?

    No. The April evaluation and call for evidence support future policymaking. The December 2026 timetable is indicative, and the options are not enacted requirements.

    Can one pack be sold unchanged in every EU country?

    Do not assume so. Harmonised TPD rules sit alongside national language, notification, flavour, tax, registration and sales-channel measures. Check each destination before release.
